Convocada por diferentes estudiosos de los Padres de la Iglesia y del cristianismo antiguo en Latinoamérica, a saber, los profesores Ana Cristina Villa Betancourt, Andrés Mauricio Quevedo Rodríguez y Estiven Valencia Marín, de Colombia; Alejandro Nicola y Francisco Basttita-Harriet, de Argentina; Bruno Gripp, de Brasil; Pamela Chávez Aguilar, de Chile; y Jesús Ma. Aguiñaga Fernández, de México.

We present a systematic and qualitative review of academic literature on early conceptual development (0–24 months of age), with an emphasis on methodological aspects. The final sample of our review included 281 studies reported in 115 articles. The main aims of the article were four: first, to organise studies into sets according to methodological similarities and differences; second, to elaborate on the methodological procedures that characterise each set; third, to circumscribe the empirical indicators that different sets of studies consider as (...) proof of the existence of concepts in early childhood; last, to identify methodological limitations and to propose possible ways to overcome them. We grouped the studies into five sets: preference and habituation experiments, category extension tasks, object sorting tasks, sequential touching tasks and object examination tasks. In the “Results” section, we review the core features of each set of studies. In the “Discussion” and “Conclusions” sections, we describe, for one thing, the most relevant methodological shortcomings. We end by arguing that a situated, semiotic and pragmatic perspective that emphasises the importance of ecological validity could open up new avenues of research to better understand the development of concepts in early childhood. On the other hand, the Vietnamese economy has several challenges, in particular because of its high public debt. Also, the two goals of GDP growth and inflation control are often not mutually supportive.

En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. We also see that is possible to see how the preventive rule was designed out of the general theory of administrative act, because it has characteristics that make it unique in the Colombian legal (...) system. -/- En este capítulo se estudia la figura de la 'facultad a prevención' contenida en la Ley 1333 de 2009, para analizar la forma en la que el derecho ambiental ha venido construyendo una dogmática y reglas propias, escapando de la tradición del derecho administrativo, así como creando la dogmática propia necesaria para lograr su independencia y consolidación como un área autónoma de la disciplina jurídica. Al respecto, en este ejercicio de reflexión es posible ver cómo la figura aparte de estar diseñada por fuera de la teoría general del acto administrativo, también posee particularidades que la hacen única dentro del ordenamiento jurídico colombiano. El paper realiza una exposición sobre el concepto y contenido de la nulidad y el restablecimiento del derecho como medio de control a la luz de la Ley 1437 de 2011; enfocándola en asuntos ambientales a través del estudio de la licencia ambiental.

En este capítulo se analiza la figura de la obtención vegetal: su alcance, dimensión, requisitos y caracterización frente a otros derechos de propiedad intelectual, para así abordar su ámbito de protección y su tratamiento en el ámbito internacional. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Con lo anterior se lleva a cabo un singular esfuerzo para tratar de forma comprensiva este asunto, buscando la primacía del consentimiento libre, previo e informado de las comunidades potencialmente afectadas. Throughout the biological and biomedical sciences there is a growing need for, prescriptive ‘minimum information’ (MI) checklists specifying the key information to include when reporting experimental results are beginning to find favor with experimentalists, analysts, publishers and funders alike. Such checklists aim to ensure that methods, data, analyses and results are described to a level sufficient to support the unambiguous interpretation, sophisticated search, reanalysis and experimental corroboration and reuse of data sets, facilitating the extraction of maximum value from data sets (...) them. However, such ‘minimum information’ MI checklists are usually developed independently by groups working within representatives of particular biologically- or technologically-delineated domains. Consequently, an overview of the full range of checklists can be difficult to establish without intensive searching, and even tracking thetheir individual evolution of single checklists may be a non-trivial exercise. Checklists are also inevitably partially redundant when measured one against another, and where they overlap is far from straightforward. Furthermore, conflicts in scope and arbitrary decisions on wording and sub-structuring make integration difficult. This presents inhibit their use in combination. Overall, these issues present significant difficulties for the users of checklists, especially those in areas such as systems biology, who routinely combine information from multiple biological domains and technology platforms. To address all of the above, we present MIBBI (Minimum Information for Biological and Biomedical Investigations); a web-based communal resource for such checklists, designed to act as a ‘one-stop shop’ for those exploring the range of extant checklist projects, and to foster collaborative, integrative development and ultimately promote gradual integration of checklists. Research, innovation, and progress in the life sciences are increasingly contingent on access to large quantities of data. This is one of the key premises behind the “open science” movement and the global calls for fostering the sharing of personal data, datasets, and research results. This paper reports on the outcomes of discussions by the panel “Open science, data sharing and solidarity: who benefits?” held at the 2021 Biennial conference of the International Society for the History, Philosophy, and Social Studies (...) of Biology, and hosted by Cold Spring Harbor Laboratory. The target article attempted to draw connections between broad swaths of evidence by noticing a common thread: Abstract, symbolic, compositional codes, that is, language-of-thoughts (LoTs). Commentators raised concerns about the evidence and offered fascinating extensions to areas we overlooked. Here we respond and highlight the many specific empirical questions to be answered in the next decade and beyond.

The stream of human consciousness appears to be interruptible, in that we can experience a sensation of ‘returning to ourselves after an absence of content’ (e.g. sleep, anaesthesia, full-absorption meditation). Prima facie, such evidence poses a challenge to simple applications of theories of consciousness based on electromagnetic or neural activity in the brain, because some of this activity persists during periods of interruption. This paper elaborates one of several possible responses to the challenge. We build on a previous theory in (...) which EM field topology delineates complex macrophenomenal experience. We first apply an analytic lens to identify different ways in which field topologies might generate sensations of ‘absence of content’. We then test the feasibility of a particular phenomenological approach for assessing those field topologies, powered by the unusual lucidity about cessation pathways induced via certain meditation practices and psychedelic dosages. We build computational simulations of these cessation pathways and test them on eight interviewees with various levels of experience in cessation states. We conclude that this approach can generate usable insight, but requires further formalisation to fulfil its potential. The findings tentatively support our claims but the theory remains speculative at this stage. We set out empirical tests with 11 specific predictions, both for further phenomenological research and for brain manipulation research. Although they align neatly, our ontological and cessation theories can also be separated. The paper describes how our theories can be consistent with other perspectives on consciousness, such as variants of predictive processing or global network theory. (shrink)

The boundary problem is related to the binding problem, part of a family of puzzles and phenomenal experiences that theories of consciousness (ToC) must either explain or eliminate. By comparison with the phenomenal binding problem, the boundary problem has received very little scholarly attention since first framed in detail by Rosengard in 1998, despite discussion by Chalmers in his widely cited 2016 work on the combination problem. However, any ToC that addresses the binding problem must also address the boundary problem. (...) The binding problem asks how a unified first person perspective (1PP) can bind experiences across multiple physically distinct activities, whether billions of individual neurons firing or some other underlying phenomenon. To a first approximation, the boundary problem asks why we experience hard boundaries around those unified 1PPs and why the boundaries operate at their apparent spatiotemporal scale. We review recent discussion of the boundary problem, identifying several promising avenues but none that yet address all aspects of the problem. We set out five specific boundary problems to aid precision in future efforts. We also examine electromagnetic (EM) field theories in detail, given their previous success with the binding problem, and introduce a feature with the necessary characteristics to address the boundary problem at a conceptual level. Topological segmentation can, in principle, create exactly the hard boundaries desired, enclosing holistic, frame-invariant units capable of effecting downward causality. The conclusion outlines a programme for testing this concept, describing how it might also differentiate between competing EM ToCs. (shrink)

NUTRIÇÃO SOBRE AS FALHAS REPRODUTIVAS DOS BOVINOS -/- E. I. C. da Silva Departamento de Agropecuária – IFPE Campus Belo Jardim Departamento de Zootecnia – UFRPE sede -/- -/- FALHAS REPRODUTIVAS DE BOVINOS -/- INTRODUÇÃO -/- Os bovinos, assim como tantos outros mamíferos e demais espécies, podem sofrer distúrbios durante o ciclo reprodutivo. Transtornos, alterações ou patogenias afetam diretamente a saúde do sistema reprodutor desses animais. As causas podem ser individuais ou multifatoriais, de caráter parasitário, patogênico, climático, nutricional etc. As (...) causas de caráter parasitário podem ser controladas mediante a assepsia e profilaxia para a eliminação dos parasitas como carrapatos que vivem no mesmo habitat que o animal. As de caráter patogênico, como estão relacionadas à doenças, necessitam de especialistas na área, como o médico-veterinário para a avaliação, diagnóstico e tratamento por meio de práticas cirúrgicas ou na administração de fármacos. O fator clima pode ser controlado mediante o investimento em tecnologia e aquisição de equipamentos que possam manter a integridade e o bem-estar do animal, seja por ventiladores, exaustores, nebulizadores, aspersores, etc. Por fim, as de caráter nutricional podem ser prevenidas mediante a boa administração energética, proteica e mineral, além de uma boa qualidade de alimento volumoso ou concentrado que atenda e supra os requerimentos exigidos por cada categoria animal. Sendo assim, pode-se dividir as falhas reprodutivas dos machos bovinos relacionados à nutrição em energia, proteína, minerais e vitaminas. Antes disso, essas falhas estão relacionadas aos fatores de degeneração testicular e casos de hipospermia. -/- 17.1 Degeneração testicular e Hipospermia -/- Degeneração testicular é uma importante causa de infertilidade em machos de todas as espécies. Entre as causas, podem ser consideradas a elevação da temperatura testicular (por isso torna-se importante que a bolsa escrotal tenha um certo tamanho que permita aos testículos ficarem longe do corpo, uma vez que a temperatura corporal mataria os espermatozoides, sendo essencial os testículos ficarem “caídos” para que possam ter no mínimo 2-3 °C à mesmos do que a temperatura corporal), infecções, fatores nutricionais, lesões vasculares, lesões obstrutivas etc. O testículo com degeneração mostra diminuição de tamanho, fibrose, alterações na espermatogênese, aumento de esperma imaturo ou anormal e azoospermia em casos severos. -/- Em casos de lesão testicular com dano parcial sobre o epitélio germinal, apresenta-se uma menor taxa de formação e maturação das células espermáticas. O macho pode ser fértil, mas a condição de hipospermia levará à que, sob condições de estresse ou alta carga de fêmeas a cobrir, se apresentem falhas na fertilização. Ejaculados com características de hipospermia não podem ser congelados, logo não servem para a indústria do sêmen. -/- -/- Deficiências nutricionais retardam o início da puberdade e deprimem a produção e as características do sêmen. Os efeitos da má nutrição podem ser corrigidos em animais maduros, enquanto que é menos bem sucedido em animais jovens devido aos danos permanentes causados no epitélio germinal do testículo. (FRAZER, 2005; GORDON, 1996). Entre as principais limitantes de origem nutricional temos: -/- 17.2 Vitaminas -/- 17.2.1 Vitamina A -/- A deficiência de vitamina A e provitamina A (já que é essencial direta ou indiretamente para a função de todos os órgãos e particularmente para o crescimento e desenvolvimento dos epitélios) é necessária para a diferenciação celular, processo no qual se modificam as células não especializadas de modo que possam realizar funções específicas. Os órgãos reprodutores exigem retinol para que possam realizar o processo de espermatogênese normal nos machos e para prevenir a necrose placentária e a mortalidade fetal na fêmea. Carências de Vitamina A produzem: degeneração do epitélio germinal, baixa espermiogênese parcial ou total, cornificação do epitélio vaginal, irregularidades do estro, atrasos na concepção, abortos, crias fracas e/ou deficientes visuais (cegas) e uma degeneração da placenta e a retenção da mesma. A deficiência da vitamina A pode conduzir a uma degeneração dos tubos seminíferos nos bovinos jovens e deve-se ao fato da supressão da liberação de gonadotropinas hipofisárias e noutros casos, a espermatogênese é impedida e as funções das células de Sertoli e de Leydig são alteradas. A vitamina A não é sintetizada no organismo, o que leva a uma dependência direta do fornecimento dessa vitamina através dos alimentos que o criador têm na propriedade, seja forragens ou concentrados de ótima qualidade. -/- Essa vitamina é essencial para os animais e humanos, visto que participa de inúmeras funções metabólicas no corpo dos mesmos. Sendo assim, o criador deve saber das exigências vitamínicas do seu rebanho. Em bovinos de corte a exigência e a recomendação de fornecimento dessa vitamina está entre 2200 UI/kg de MS para animais em crescimento e engorda e para reprodutores recomenda-se níveis de 3900 UI/kg de MS. Já para bovinos leiteiros esses números são diferentes, de acordo com livros de nutrição de ruminantes, animais em crescimento e engorda devem consumir matéria seca com teores de 80 UI/kg de MS, já para reprodutores e animais adultos a quantidade recomendada e exigida é de 110 UI/kg de MS, isso diariamente. As forragens suprem bem a exigência de vitamina A dos animais, em especial o capim tifton e o tanzânia são os mais recomendados uma vez que possuem altos teores vitamínicos e minerais. As vias de suplementação dessa vitamina é através das forragens (mais acessível e barato), através da ração concentrada ou pela água e suplementação injetável. -/- 17.2.2 Vitamina E -/- A vitamina E é uma substância também conhecida como tocoferol, sendo sua forma mais ativa o alfa tocoferol. A vitamina E pertence ao grupo de vitaminas lipossolúveis amplamente distribuídas nos alimentos. -/- A sua principal função é descrita como um antioxidante natural, agindo como tal, a vitamina E evita a oxidação de constituintes celulares essenciais e/ou evita a formação de produtos tóxicos de oxidação, como os produtos de peroxidação formados a partir de ácidos graxos insaturados que foram detectados através de sua ausência. Essa vitamina é essencial para a reprodução normal em várias espécies de mamíferos. Ela ainda têm sido usada em clínicas reprodutivas de todo o mundo para o tratamento de abortos recorrentes e da infertilidade em ambos os sexos (CHAN, 2003). -/- -/- A deficiência da vitamina E influencia a maturação espermática e a degeneração do epitélio germinal dos túbulos seminíferos, já que ela os protege da oxidação evitando a deterioração da peroxidase sobre os fosfolipídios poli-insaturados da membrana espermática (PITA RODRÍGUEZ, 1997). A deficiência dessa também evita o crescimento anormal. Na ausência de vitamina E, a quantidade de gorduras insaturadas dentro das células diminuem, causando anomalias estruturais e funcionais das organelas mitocondriais, lisossomos e até mesmo na membrana celular, se essa falta de vitamina E no adulto tornar-se acentuada ocorrerá a degeneração precoce do epitélio germinal, o que afeta, em primeiro lugar, as células mais evoluídas: os espermatozoides, cuja mobilidade se perde e sua formação torne-se cada vez mais rara, até chegar ao nível de esterilidade completa. -/- As exigências dos bovinos de corte quanto a vitamina em questão é de 15 – 60 UI/kg de MS diárias para animais em crescimento e engorda. Já para bovinos leiteiros, essa exigência é muito menor chegando a 0,8 UI/kg de peso vivo (PV) para animais em crescimento e engorda e para animais adultos e reprodutores cerca de 1,6 UI/kg de PV diários. Os alimentos, assim como as vias de suplementação ideais, são os mesmos mencionados no tópico acerca da vitamina A. -/- 17.3 Proteínas -/- O efeito do excesso de proteína da dieta na reprodução é complexo. Os excessos de proteína podem também ter um efeito negativo na reprodução. Alguns efeitos foram demonstrados para explicar o pobre desempenho reprodutivo que algumas vezes é observado em dietas com excessivos níveis de proteína: Podem apresentar-se altos níveis de ureia no sangue, o que possui efeito tóxico sobre os espermatozoides, óvulos, e o embrião em desenvolvimento (WATTIAUX, 1990), igualmente, apresenta-se um desequilíbrio energético que em casos severos bloqueia a liberação de LH produzindo alteração na maturação espermática nas células de Leyding. -/- As proteínas são importantes para todo o funcionamento normal e funções fisiológicas e metabólicas dos animais e do homem. Logo, a tabela 1 traz os níveis recomendados e exigências de bovinos de corte de diferentes categorias para que se possa prevenir e/ou combater as possíveis degenerações testiculares bem como a hipospermia, trazendo os requerimentos de bovinos leiteiros jovens o que é mais ideal para combater previamente esses distúrbios que afetam diretamente a função reprodutiva e o desemprenho dos animais. -/- Tabela 1: Exigências de proteína metabolizável (PM) e proteína bruta (PB), para diferentes categorias de bovinos de corte -/- BAIXE O PDF E VISUALIZE A TABELA -/- Para os bovinos leiteiros jovens, os níveis de PB presente na dieta dos animais entre 150 e 400 kg de PV podem ser entre 12 e 22%, o que é ideal para a prevenção de degenerações, atraso à puberdade ou qualquer anormalidade que afete o desempenho dos animais. -/- Os alimentos mais proteicos são os de origem animal, porém não se pode ofertá-los completamente e diretamente aos animais, isto é, deve-se misturá-los a outros ingredientes; logo, o tipo e a quantidade de proteína depende dos ingredientes, do método de alimentação e do potencial produtivo e genético dos animais. -/- 17.4 Minerais -/- 17.4.1 Manganês (Mn) -/- O manganês é um componente de várias enzimas e essencial para a estrutura óssea normal. Quando a alimentação é deficiente em Mn por algumas semanas, o corpo parece conservar este mineral de forma eficaz. -/- Numa dieta média, cerca de 45% do mineral ingerido é absorvido. A absorção pode ser diminuída com o consumo de quantidades excessivas de Ca, P ou Fe. Após a absorção, o Mn liga-se à sua proteína transportadora e é conhecido como transmanganina. Os ossos, e em menor quantidade o fígado, músculos, e pele servem como locais de armazenamento desse mineral. -/- O Mn está envolvido na função pancreática e na utilização correta da glicose, sendo também um interveniente ativo na produção de tiroxina e de hormonas sexuais. Tem importância na produção do colesterol e no metabolismo de gorduras. -/- O Mn é um mineral de grande afinidade com o aparelho reprodutor. A deficiência desse elemento produz uma diminuição da fertilidade, atraso no desenvolvimento testicular e diminuição da espermatogênese. Se houver atrofia dos testículos, a produção de espermatozoides será reduzida e, portanto, a fertilidade será afetada. -/- A quantidade de 13 mg de Mn por kg de MS é suficiente para a obtenção de um crescimento adequado, mas para um crescimento testicular ideal e constante é necessário um mínimo de 16 mg de Mn por kg de MS. -/- Para uma boa suplementação que atenda às necessidades do gado de corte e leite, o nível ideal de Mn presente na MS em mg/kg deve estar entre 12 – 18 para os bovinos leiteiros e entre 20 – 50 para o gado de corte, tendo como recomendação ideal cerca de 40 mg/kg de MS diários para ambos. Esse mineral pode estar presente tanto na água quanto nas plantas presentes no pasto, portanto a suplementação natural é a melhor escolha, caso necessário a suplementação artificial através da ração no cocho ou do sistema SMI é recomendada. -/- 17.4.2 Iodo (I) -/- A deficiência de I também ocasionar dificuldades reprodutivas e hipospermia. Só a captação da tiroide responde à TSH, e somente a glândula endócrina tiroide incorpora esse elemento nos hormônios que são por ela elaborados. Assim, mais de 90% do iodo do organismo é encontrado nas glândulas tireóideas, principalmente como iodo orgânico. Este grande acúmulo de I na glândula é trocado muito lentamente, cerca de 1% por dia. -/- O I entra no organismo via oral e sob a forma de íon iodeto, absorvendo-se muito facilmente desde o aparelho digestivo e passando rapidamente à corrente circulatória e, posteriormente à glândula tiroide (ALBARRACÍN, 2005) onde tem que vencer um gradiente de concentração de 1 a 20; todavia, dada a afinidade entre essa glândula e o iodo, não existe nenhum problema na organização. Na célula folicular, através da ação da peroxidase, converte-se em I molecular que passa para o coloide para se ligar à tiroglobulina e formar as hormonas tireóideas. -/- O I pode atuar sobre o aparelho genital diretamente ou através da hipófise. A tiroidectomia reduz a produção espermática, por sua vez a tiroxina exótica pode restaurá-la. Essa última, administrada dentro de seus limites fisiológicos, aumenta a produção espermática ao incrementar o metabolismo geral. Seen from the point of view of evaluation conditions, a usual way to obtain a connexive logic is to take a well-known negation, for example, Boolean negation or de Morgan negation, and then assign special properties to the conditional to validate Aristotle’s and Boethius’ Theses. Nonetheless, another theoretical possibility is to have the extensional or the material conditional and then assign special properties to the negation to validate the theses. In this paper we examine that possibility, not sufficiently explored in (...) the connexive literature yet.We offer a characterization of connexive negation disentangled from the cancellation account of negation, a previous attempt to define connexivity on top of a distinctive negation. We also discuss an ancient view on connexive logics, according to which a valid implication is one where the negation of the consequent is incompatible with the antecedent, and discuss the role of our idea of connexive negation for this kind of view. News about personal data breaches or data abusive practices, such as Cambridge Analytica, has questioned the trustworthiness of certain actors in the control of personal data. Innovations in the field of personal information management systems to address this issue have regained traction in recent years, also coinciding with the emergence of new decentralized technologies. However, only with ethically and legally responsible developments will the mistakes of the past be avoided. This contribution explores how current data management schemes are insufficient to (...) adequately safeguard data subjects, and in particular, it focuses on making these data flows transparent to provide an adequate level of accountability. To showcase this, and with the goal of enhancing transparency to foster trust, this paper investigates solutions for standardizing machine-readable policies to express personal data processing activities and their application to decentralized personal data stores as an example of ethical, legal, and technical responsible innovation in this field. Panpsychism is a striking metaphysical claim: every part of the physical world has some form of consciousness. Does this striking claim have equally striking ethical implications? Does it change what duties we owe to which beings, or how we should understand the relation between self-interest and altruism? Some defenders as well as critics of panpsychism have suggested it does. Others have disagreed. In this paper, we attempt to survey and organize these existing discussions. We suggest that panpsychism is likely to (...) have significant implications, but that they 1) stop short of some of the most radical implications sometimes associated with the view (by both critics and proponents), and 2) often depend heavily on the exact sort of panpsychism that is endorsed, as well as how one settles various independent questions about value and identity. This paper argues that there is a class of terms, or uses of terms, that are best accounted for by an expressivist account. We put forward two sets of criteria to distinguish between expressive and factual terms. The first set relies on the action-guiding nature of expressive language. The second set relies on the difference between one's evidence for making an expressive vs. factual statement. We then put those criteria to work to show, first, that the basic evaluative adjectives such (...) as ‘good’ have expressive as well as factual uses and, second, that many adjectives whose primary meanings are factual, such as ‘powerful’, also have expressive uses. Four studies explore the role of perceptual fluency in attenuating bullshit receptivity, or the tendency for individuals to rate otherwise meaningless statements as “profound”. Across four studies, we presented participants with a sample of pseudoprofound bullshit statements in either a fluent or disfluent font and found that overall, disfluency attenuated bullshit receptivity while also finding little evidence that this effect was moderated by cognitive thinking style. In all studies, we measured participants’ cognitive reflection, need for cognition, faith in intuition, and (...) superstitious beliefs. Superstition strongly predicted bullshit receptivity regardless of fluency. Inconclusive results were found for the remaining scales. Potential links for the role of perceptual disfluency in promoting analytic thinking are discussed. (shrink)

In a recent work, Walter Carnielli and Abilio Rodrigues present an epistemically motivated interpretation of paraconsistent logic. In their view, when there is conflicting evidence with regard to a proposition A (i.e. when there is both evidence in favor of A and evidence in favor of ￢A) both A and ￢A should be accepted without thereby accepting any proposition B whatsoever. Hence, reasoning within their system intends to mirror, and thus, should be constrained by, the way in which we reason (...) about evidence. In this article we will thoroughly discuss their position and suggest some ways in which this project can be further developed. The aim of the paper is twofold. On the one hand, we will present some philosophical critiques to the specific epistemic interpretation of paraconsistent logic proposed by Carnielli & Rodrigues. First, we will contend that Carnielli & Rodrigues’s interpretation implies a thesis about what evidence rationally justifies to accept or believe, called Extreme Permissivism, which is controversial among epistemologists. Second, we will argue that what agents should do, from an epistemic point of view, when faced with conflicting evidence, is to suspend judgment. On the other hand, despite these criticisms we do not believe that the epistemological motivation put forward by Carnielli & Rodrigues is entirely wrong. In the last section, we offer an alternative way in which one might account for the epistemic rationality of accepting contradictions and, thus, for an epistemic understanding of paraconsistency, which leads us to discuss the notion of diachronic epistemic rationality. Los estudiantes de la Facultad de Ciencias Económicas y de Administración de la Universidad de la República deben realizar, como trabajo final de carrera, una investigación o ensayo monográfico en un área de su interés, tutorados por un docente universitario o un investigador de reconocida trayectoria. Un gran número de estos trabajos monográficos han hecho un aporte valioso al conocimiento pero, lamentablemente, la poca difusión de éstos hace que ese conocimiento termine olvidado en los fondos de la biblioteca de la (...) Facultad, entre cientos de producciones monográficas. Se pretende en este libro, mostrar los aportes que se han generado en el área tanto de Economía de la Cultura como de Gestión de Organizaciones Culturales. Varias de las monografías fueron realizadas en la línea de investigación Costos y Gestión de Organizaciones Culturales, la cual coordino. Otros fueron realizados con antelación, como los trabajos tutorados por el referente de la Economía de la Cultura en Uruguay, el hoy fallecido Luis Stolovich. También se incluyen dos trabajos monográficos tutorados por el Dr Gustavo Buquet, quien siempre está presente a la hora de crear investigación de calidad en Economía de la Cultura. Como cada trabajo supera el centenar de páginas, no es posible publicarlos completamente, por lo que para este libro se hicieron resúmenes de esos trabajos, intentando adecuar la terminología y quitándoles el formato estrictamente científico –poco amigable para un no especialista-, de forma tal que su lectura sea accesible al público en general. Se resumieron ocho, clasificados en tres capítulos: Patrimonio, Artes Escénicas e Industria Cultural. El capítulo de Patrimonio comienza con un trabajo realizado por las Economistas Fernanda Arezo y Verónica Pereyra, titulado “Museos y Ciudadanos, el comportamiento del consumidor”, tutorado por Raúl Ramírez y por mí. Este estudio tuvo como centro explicar la modalidad de conducta de consumo del visitante montevideano hacia tres importantes instituciones museísticas como lo son el Museo del Cabildo, el Museo del Carnaval y el Museo de Historia del Arte. El objetivo del trabajo es estimar la demanda y obtener un indicador de la propensión a pagar por el consumo de dichos museos. El segundo trabajo, titulado “Disposición a pagar por la restauración de la Puerta de la Ciudadela”, fue realizado por las Contadoras Beatriz Torres, María Elena Olarán y María Carolina Duarte, y tutorado en forma conjunta por el Phd. Juan José Goyeneche y quien les escribe. En este trabajo se realiza una valoración contingente para medir la disposición a pagar por la restauración de la “Puerta de la Ciudadela”, un monumento fundamental de identidad montevideana. El capítulo de Patrimonio finaliza con un trabajo realizado por las Economistas Malena Rodríguez y María de la Paz Besada y tutorado por el Ec. Luis Stolovich. El mismo se denomina “El arte uruguayo: un estudio sobre el mercado y la pintura como alternativa de inversión” y explora el mercado de arte uruguayo, analizando la rentabilidad de la inversión en pintura uruguaya. Tratan la rentabilidad de la inversión para tres casos específicos: las obras vendidas por el Banco Comercial en su proceso de recuperación de activos, un portafolio de obras de Pedro Figari y otro de Joaquín Torres García. En cuanto al segundo capítulo, Artes Escénicas, comienza con un trabajo realizado para la obtención del título de Contador Público realizado por Pamela Cambeiro, Martín Cami e Ignacio Mouradián. Se denomina “La gestión de teatros. Caso de estudio: Aplicación del Cuadro de Mando Integral al Teatro Solís” y trata sobre la identificación de indicadores que faciliten las tareas de gestión para la dirección del Teatro. Luego se presenta un trabajo realizado por las Economistas Tania Cruz y Natalia Nollenberger titulado “Análisis económico del teatro independiente en Montevideo: una aproximación al problema de la fatalidad de los costos”. Este trabajo, también tutorado por el Ec. Luis Stolovich, muestra un exhaustivo análisis del teatro independiente montevideano identificando los problemas económicos que afectan al sector. El capítulo de Industria Cultural incluye tres trabajos. El primero, fue realizado por el Economista Diego Traverso y tutorado por el Dr. Gustavo Buquet, y su título es “Análisis de competitividad del sector exportador de Productoras Audiovisuales Publicitarias en Uruguay”. El sector audiovisual publicitario es un sector dinámico que se ha internacionalizado tempranamente y que generó divisas para el país del orden de los US$ 24 millones durante el año 2005 por concepto de exportaciones. En este trabajo se caracteriza al sector audiovisual publicitario en Uruguay y se analiza las ventajas competitivas que posee frente a sus principales competidores extranjeros. El segundo trabajo fue realizado por las Contadoras Natalia Rivera, Antonella Triay y María Eugenia Triay y se denomina “Gestión aplicada a las empresas radiales”. En este se identifican el sector radial, su proceso productivo y la complejidad al definir al “cliente”. Se proponen una serie de indicadores con el doble objetivo de medir el desempeño de la empresa y proveer incentivos a su organización. Finalmente, el último trabajo monográfico, fue una investigación interdisciplinaria, que sirvió simultáneamente para obtener el título de Licenciado en Economía a Ernesto Pienika y el de Licenciado en Administración a Nicolás Cohnheim y a Damián Geinsinger. Este trabajo, tutorado por el Dr. Gustavo Buquet y el Cr. Cecilio García de título “Impactos de las nuevas tecnologías en la .industria musical”, muestra cuáles son los principales impactos en esa industria que las nuevas tecnologías han provocado y cuáles son las posibles estrategias para adaptarse a estos cambios, así como los nuevos modelos de negocio. Espero que este libro sea el primero de una larga lista. Las áreas de Economía de la Cultura y Gestión de Organizaciones Culturales son disciplinas jóvenes que necesitan seguir creciendo. La investigación realizada por trabajos monográficos de fin de carrera en estas áreas, será siempre bienvenida. (shrink)

Contemporary Peruvian Philosophers (20th & 21st Centuries).

Exposed in 1948, within his masterpiece on the scope and limits of human knowledge, the epistemological tenets that Bertrand Russell regarded as fundamental elements in the construction of scientific knowledge, are still worthy of a detailed discussion today. Given the excellence of the author, it will not be surprising to see that Russell's gnoseologic postulates, even for the present scientific view, address some of the most controversial questions still to be solved in the theory of knowledge.

En este ensayo intentaremos realizar una pequeña aproximación al pensamiento de Gilbert Simondon, filósofo francés cuya obra podría resumirse en sus dos tesis doctorales defendidas en 1958, una de las cuales no fue publicada de forma completa sino póstumamente. No obstante, lo dicho, tras el creciente interés en su pensamiento comenzaron a publicarse ya nacido este milenio, en particular en Argentina, sus cursos sobre percepción, imaginación, invención, información, comunicación y tecnología. A pesar de su escueta obra, Simondon es un filósofo (...) de sistema, que a partir de su teoría de la individuación intentó fundar un monismo ontogenético en el cual puedan entrar en comunicación todas las disciplinas humanas; y para ello buscó explotar todos los recursos conceptuales que brindaron las revoluciones científicas de su época. En este ensayo, sin embargo, abordaremos tan sólo el tipo de realidad o estatus ontológico que Simondon atribuía a los objetos técnicos. Para ello desarrollaremos 4 apartados y un bis. En el primero, haremos un esbozo de lo que es el método filosófico propuesto por Simondon, el cual describimos como un paradigmatismo analógico. En el segundo, desarrollaremos algunas críticas a cierto paradigmatismo particular que, según Simondon, subyace en gran parte del pensamiento occidental y que nos impide, entre otras cosas, comprender la realidad propia de los OT, a saber: el hilemorfismo. En tercer lugar, analizaremos en qué medida podemos salvar la realidad de los OT de ser reducida a mero constructo social. En cuarto lugar; analizaremos algunas analogías y disparidades entre los OT y los seres vivientes. Por último, a modo de apéndice, expondremos sucintamente un artículo de Esperanza García y Villegas Jaraleño, presentado en el último volumen de Scientia in verba, en el cual se plantea la pregunta sobre el estatus ontológico de los artefactos biotecnológicos desde una perspectiva bungeana; así como pequeñas críticas y aportes que pudiésemos hacerle desde el pensamiento simondoniano. Ontology engineering is a hard and error-prone task, in which small changes may lead to errors, or even produce an inconsistent ontology. As ontologies grow in size, the need for automated methods for repairing inconsistencies while preserving as much of the original knowledge as possible increases. Most previous approaches to this task are based on removing a few axioms from the ontology to regain consistency. We propose a new method based on weakening these axioms to make them less restrictive, employing (...) the use of refinement operators. We introduce the theoretical framework for weakening DL ontologies, propose algorithms to repair ontologies based on the framework, and provide an analysis of the computational complexity. Through an empirical analysis made over real-life ontologies, we show that our approach preserves significantly more of the original knowledge of the ontology than removing axioms. (shrink)

Natural selection is one of the fundamental keys of evolutionary biology, which is as much as saying of almost all life sciences. However, the effort to assess its true meaning has been involved in endless controversies almost from the beginning. The rethinking of natural selection through an abstract scheme with three ingredients - −population, environment and interaction between them− could significantly contribute to clarify this debate.

“What is the structure of thought?” is as central a question as any in cognitive science. A classic answer to this question has appealed to a Language of Thought (LoT). We point to emerging research from disparate branches of the field that supports the LoT hypothesis, but also uncovers diversity in LoTs across cognitive systems, stages of development, and species. Our letter formulates open research questions for cognitive science concerning the varieties of rules and representations that underwrite various LoT-based systems (...) and how these variations can help researchers taxonomize cognitive systems. El objetivo del presente trabajo es reflexionar sobre el pensamiento heideggeriano, principalmente en torno al concepto de Ereignis, el cual puede encontrarse con múltiples traducciones, las principales de ellas: acaecimiento, evento, acontecimiento, suceso, etc. Analizaremos el devenir del concepto en el pensamiento del filósofo alemán, como también la relevancia del mismo en su filosofía del lenguaje. Para finalizar, abordaremos la importancia del concepto de Evento (Ereignis), no solo en el lenguaje sino también en la dimensión histórica del Dasein. The aim (...) of this paper is to reflect on heideggerian thought, mainly around the concept of Ereignis, which can be found with multiple translations, the main ones of which are: occurrence, event, happening, occurrence, etc. We will analyze the development of the concept in the German philosopher's thought, as well as its relevance in his philosophy of language. Según varios filósofos del lenguaje contemporáneos, el argumento Frege-Geach plantea una objeción genuina para el expresivismo semántico. En el presente texto se sostiene que una manera eficaz de enfrentar y superar este argumento es modificando la concepción expresivista clásica. Se examinan el expresivismo clásico y el expresivismo mínimo y se propone una versión de este último que, a la vez que supera la objeción derivada del argumento Frege-Geach, tiene la ventaja de incluir dentro del espectro del expresivismo teorías que claramente (...) tienen este “espíritu” pero que la caracterización clásica deja fuera. People sometimes explain behavior by appealing to an essentialist concept of the self, often referred to as the true self. Existing studies suggest that people tend to believe that the true self is morally virtuous; that is deep inside, every person is motivated to behave in morally good ways. Is this belief particular to individuals with optimistic beliefs or people from Western cultures, or does it reflect a widely held cognitive bias in how people understand the self? To address this (...) question, we tested the good true self theory against two potential boundary conditions that are known to elicit different beliefs about the self as a whole. Study 1 tested whether individual differences in misanthropy—the tendency to view humans negatively—predict beliefs about the good true self in an American sample. The results indicate a consistent belief in a good true self, even among individuals who have an explicitly pessimistic view of others. Study 2 compared true self-attributions across cultural groups, by comparing samples from an independent country and a diverse set of interdependent countries. Results indicated that the direction and magnitude of the effect are comparable across all groups we tested. The belief in a good true self appears robust across groups varying in cultural orientation or misanthropy, suggesting a consistent psychological tendency to view the true self as morally good. Se expone, en este trabajo, una teoría que muestra cómo es que el hombre extrae desde su propio fondo ciertas ideas innatas que proyecta en los entes que percibe y que piensa, particularmente las ideas de ser y de unidad. Además, se muestra que el grado de proyección de estas ideas (las ideas de ser y de unidad) sobre los entes que el entendimiento percibe, está en función del grado de alegría o de angustia que un hombre siente. Para el (...) análisis de las ideas innatas y de las emociones, me baso sobre todo en la filosofía racionalista (Descartes, Spinoza y Leibniz). Aunque, para el análisis de las emociones, también me apoyo en la filosofía heideggeriana. Por último, reflexionando a partir del horizonte del pensamiento analógico, trazado por Beuchot, se expone cómo esta teoría innatista de la proyección puede servir para responder al relativismo absoluto de la posmodernidad. In response, Explainable AI (XAI) has emerged as a field of research with practical and ethical benefits across various domains. This paper not only highlights the advancements in XAI and its application in real-world scenarios but also addresses the ongoing challenges within XAI, emphasizing the need for broader perspectives and collaborative efforts. We bring together experts from diverse (...) fields to identify open problems, striving to synchronize research agendas and accelerate XAI in practical applications. By fostering collaborative discussion and interdisciplinary cooperation, we aim to propel XAI forward, contributing to its continued success. Our goal is to put forward a comprehensive proposal for advancing XAI. To achieve this goal, we present a manifesto of 27 open problems categorized into nine categories. These challenges encapsulate the complexities and nuances of XAI and offer a road map for future research. El avance tecnológico de los últimos años nos lleva a imaginar un futuro, no muy lejano, donde los sistemas tecnológicos y la inteligencia artificial (AI) supere a la inteligencia humana (HI), inclusive con la capacidad de auto generarse, denominando ésto como Singularidad Tecnológica. Razón por lo cual surge la posibilidad de fusión entre ambas inteligencias, dando lugar así al surgimiento de Cyborgs o Post Humanos y la llegada de lo que los expertos han dado en llamar Transhumanismo. Me planteo reflexionar (...) sobre esta posibilidad con el fin de analizar las posibles consecuencias que traería consigo una super inteligencia dura. -/- The technological advance of recent years leads us to imagine a future, not too distant, where technological systems and artificial intelligence (AI) surpass human intelligence (HI), even with the ability to self-generate, calling this as Singularity Technological. Reason why the possibility of merging between the two intelligences arises, thus giving rise to the emergence of Cyborgs or Post Humans and the arrival of, what experts have called, Transhumanism. A la fecha, la academia hispanohablante ha abordado el pensamiento de Stefan Lorenz Sorgner analizando, casi exclusivamente, su intento de comprender a Nietzsche como un precursor del transhumanismo. Más allá de los alegatos a favor o en contra de tal lectura, este debate olvida que el pensamiento de Sorgner efectivamente se ha apropiado de varias intuiciones nietzscheanas, hasta el punto de crear su propio transhumanismo nietzscheano débil o bien, Metahumanismo. Con este contexto en mente, el presente artículo tiene tres objetivos (...) específicos:(1) ofrecer una caracterización que diferencia al Metahumanismo de Sorgner tanto del trans-como del post-humanismo;(2) señalar cómo se modulan las ideas de Nietzsche en el metahumanismo de Sorgner; y finalmente (3) ilustrar cuáles son algunas de las propuestas con las que el metahumanismo enfrenta los debates contemporáneos—una perspectiva anti utópica y una propuesta por una educación metahumanista—. De esta manera, el objetivo general de este artículo es ofrecer una introducción al pensamiento del filósofo metahumanista Stefan Lorenz Sorgner. (shrink)

Spanish Abstract: A partir de un análisis desde la historia del derecho, este artículo de investigación busca demostrar la existencia de un significado de justicia social en el discurso jurídico transnacional actual que se resume en la garantía de estos tres elementos: Estado Social de Derecho, dignidad humana e igualdad de oportunidades. Con esto, se pretende superar el simple estudio de teorías de filósofos de moda como John Rawls a la hora de abordar el problema de cómo entender y materializar (...) la justicia social, particularmente, en el plano constitucional. Finalmente, con la ayuda de algunos breves estudios de caso, se espera proveer un marco mínimo útil para entender cómo la justicia social puede lograrse a través del derecho. -/- English Abstract: Based on an analysis from legal history, this paper seeks to prove the existence of a meaning of social justice in the current transnational legal discourse that can be synthetized in the warranty of these three elements: Social Rule of Law, human dignity, and equal opportunities. Thus, it aims to overcome the mere study of theories of justice drawn up by trendy philosophers like John Ralws when addressing the problem on how to understand and achieve social justice, specially, in constitutional law. Finally, with the help of some brief case studies, the author hopes to provide a minimum framework useful to understand how social justice can be realized through law. (shrink)

Our reflections on LAWS issues are the result of the work of our research group on AI and ethics at the Informatics Center in partnership with the Information Science Department, both from the Federal University of Pernambuco, Brazil. In particular, our propositions and provocations are tied to Bianca Ximenes’s ongoing doctoral thesis, advised by Prof. Geber Ramalho, from the area of computer science, and co-advised by Prof. Diego Salcedo, from the humanities. Our research group is interested in answering two tricky (...) questions: What would an ethical AI be? This paper introduces a generic agent-based model simulating the exchange and the diffusion of pro and con arguments. It is applied to the case of the diffusion of vegetarian diets in the context of a potential emergence of a second nutrition transition. To this day, agent-based simulation has been extensively used to study opinion dynamics. However, the vast majority of existing models have been limited to extremely abstract and simplified representations of the diffusion process. These simplifications impairs the realism of (...) the simulations and disables the understanding of the reasons for the shift of an actor's opinion. The generic model presented here explicitly represents exchanges of arguments between actors in the context of an opinion dynamic model. In particular, the inner attitude towards an opinion of each agent is formalized as an argumentation graph and each agent can share arguments with other agents. Simulation experiments show that introducing attacks between arguments and a limitation of the number of arguments mobilized by agents has a strong impact on the evolution of the agents' opinion. We also highlight that when a new argument is introduced into the system, the quantity and the profile of the agents receiving the new argument will impact the evolution of the overall opinion. Finally, the application of this model to vegetarian diet adoption seems consistent with historical food behaviour dynamics observed during crises. (shrink)

The article analyzes the a posteriori argumentation for the existence of God present in saint Anselm’s Monologion. It defends that the arguments in chapters I-IV are parts of a single argumentative way comparable with the fourth way of Thomas Aquinas. The only starting point for the argumentation is the evidence of the degrees of transcendental perfection (goodness and greatness) found in things. According to this single point of departure, the argument also has a single formulation of the principle of causality (...) given in chapter I. By this principle, Anselm infers the existence of a single first principle (that which is through itself) from its effects (that which is through another). Contrary to what is usually held, it is shown that chapters III and IV do not contain arguments properly meant to demonstrate God’s existence. Chapter III’s specific goal is to demonstrate the impossibility that that which is through itself may be something multiple, while chapter IV aims to demonstrate the impossibility that the supreme nature through whom all things exist may be overcome or equaled in dignity by another. Both arguments depend of the principle of causality formulated in chapter I to be conclusive. (shrink)

El presente artículo se enmarca en el contexto de la alternativa ofrecida por Quentin Meillassoux a la cuestión de la pregunta canónica ¿por qué hay algo y no más bien nada? (2018f) y pretende reflexionar sobre las condiciones que posibilitan la solución del dilema espectral (2016b) en el marco de una ontología extra científica (2020). Concebir el advenimiento de una entidad divina implicaría comprender, al menos, tres conceptos claves para el pensamiento del filósofo, a saber, el correlacionismo, factualidad y contingencia (...) absoluta. De esta manera, el objetivo principal de este artículo es esbozar una lectura introductoria a los cimientos de la filosofía de Meillassoux a fin de comprenderla como una ontología capaz de dar cuenta de la inexistencia divina. -/- The present article takes place in the context of the alternative offered by Quentin Meillas-soux to the question of the canonical question “why is there something and not rather nothing?” (2018f) and aims to reflect on the conditions that make the solution of the spectral dilemma possible (2016b) within the framework of an extra-scientific ontology (2020). To conceive of the advent of a divine entity would imply understanding at least three key concepts for the philos-opher’s thought, namely, correlationism, factuality and absolute contingency. Thus, the main objec-tive of this article is to outline an introductory reading of the fundamentals of Meillassoux’s phi-losophy in order to understand it as an ontology capable of accounting for divine non-existence. -/- . English Abstract: Through the presentation of the history of social justice in global constitutional discourse, this article aims to demonstrate that, although in Colombia there is not a constitutionalized purpose or principle of social justice, as in other countries, the modern notion of distributive justice, also called social justice today, is implicit in the Constitution of 1991 because it enshrined as mandatory rules the three main elements of its meaning at the time of its promulgation: the principle of social rule (...) of law, the principle of human dignity and the right to a material equality. Thus, in Colombia social justice must not be understood in the Aristotelian sense of distributive justice but in accordance with these three elements, and can only be achieved if they are fulfilled. -/- Spanish Abstract: Mediante la presentación de la historia de la justicia social en el discurso constitucional global, este artículo pretende demostrar que, a pesar de no existir en Colombia, como en otros países, un valor o principio constitucional de justicia social, la noción moderna de justicia distributiva, también llamada hoy justicia social, se encuentra implícita en la Constitución de 1991 porque esta consagró como normas obligatorias los tres elementos principales de su significado en el tiempo en el que fue promulgada: el principio de Estado Social de Derecho, el principio de dignidad humana y el derecho a una igualdad material. Así pues, la justicia social debe entenderse en Colombia a partir de esos tres elementos, no según el sentido aristotélico de justicia distributiva, y sólo puede ser alcanzada si ellos se cumplen. El estallido social en Chile desafı́a a las humanidades a abordar un fenómeno social inédito por sus formas, a través de un ejercicio reflexivo situado más allá de las tomas de posición en el debate público. Si bien, ha habido un sinnúmero de académicos del espectro nacional que han asumido posturas claras en esta coyuntura, las respuestas y justificaciones contingentes dejan incólumes otras dudas sobre cuestiones de principio. Sabı́amos que Chile vivı́a en una democracia de baja intensidad, con instituciones ancladas (...) al orden constitucional diseñado durante la dictadura cı́vico-militar y continuado por los gobiernos democráticos, con enormes áreas institucionales corrompidas por el fuero de la impunidad, con una clase polı́tica acostumbrada a los privilegios y bajo un modelo estructuralmente desigual en lo económico, social y cultural. Sabı́amos que todo lo anterior, en alguna medida, fue horadando las bases de las instituciones democráticas. Por eso, para muchos, las protestas que comenzaron en octubre son la continuidad de un dilatado proceso de acumulación del malestar que, debido a lo agudas de sus causas, tardaron más de lo que muchos imaginaron en llegar. The idea behind this work is to demonstrate that Western logocentrism hegemonizes in the same process of individuation. Analyze the evolution of the body through the texts would be to make a deconstruction of the capitalist system and the current market society. Undoubtedly, this system is the consecration of the idea of individual that was increasing along multiple events and allows us, not only review the appearance of the subject as such, but also as appearance of the individualism as cultural (...) current. Also it allows us to observe how they were giving various processes of individuation and like some factors have become higher hierarchies were imposed on others, which were relegated, hidden, denied. Families play an essential role in deceased organ procurement. As the person cannot directly communicate his or her wishes regarding donation, the family is often the only source of information regarding consent or refusal. We provide a systematic description and analysis of the different roles the family can play, and actions the family can take, in the organ procurement process across different jurisdictions and consent systems. First, families can inform or update healthcare professionals about a person’s donation wishes. Second, families (...) can authorize organ procurement in the absence of deceased’s preferences and the default is not to remove organs, and oppose donation where there is no evidence of preference but the default is to presume consent; in both cases, the decision could be based on their own wishes or what they think the deceased would have wanted. Finally, families can overrule the known wishes of the deceased, which can mean preventing donation, or permitting donation when the deceased refused it. We propose a schema of 4 levels on which to map these possible family roles: no role, witness, surrogate, and full decisional authority. We conclude by mapping different jurisdictions onto this schema to provide a more comprehensive understanding of the consent system for organ donation and some important nuances about the role of families. This classificatory model aims to account for the majority of the world’s consent systems. It provides conceptual and methodological guidance that can be useful to researchers, professionals, and policymakers involved in organ procurement. (shrink)

La literatura sobre razonamiento probatorio busca incidir en la determinación de los hechos en los procesos judiciales. Para alcanzar dicho propósito, no basta con dirigir la mirada hacia disciplinas extrajurídicas exitosas e integrar lo que de ellas pueda extraerse a las teorías jurídicas de la prueba y a la práctica judicial. Es necesario, además, considerar el tipo de hechos a probar, los roles de las reglas jurídicas aplicables, y asumir que litigantes y jueces, actuando en un contexto institucional, podrán ser (...) más o menos agudos en la discusión fáctica, entre otras cosas. Minimizar la influencia de tales factores expone a los estudios probatorios a tener un bajo rendimiento práctico. Algo de esto ha ocurrido con la llamada concepción racionalista de la prueba. Su innegable aporte al debate académico en español no ha ido a la par de su impacto judicial. Para explicar esta brecha entre teoría y práctica, identificamos tres creencias-obstáculo que afectan a su discurso sobre la prueba y que deben ser sorteadas si lo que se busca es influir en la forma en que se juzgan los hechos en un sistema judicial realmente existente.
